These Terms of Use govern your access to and use of the Buuk platform operated by [HOLDCO NAME](operating as Buuk), incorporated in British Columbia, Canada ("we", "us", or "our"). By creating an account or using our service, you agree to these terms.
1. Definitions
- Subscriber — a business owner who registers for a Buuk account.
- Practitioner — an individual invited by a Subscriber to use the platform.
- Customer — a person who books appointments through a Subscriber's booking portal.
- Content — any data, text, or information submitted to the platform by a Subscriber, Practitioner, or Customer.
2. Eligibility
You must be at least 18 years old to create a Subscriber account. By registering, you represent that you have the legal authority to enter into these Terms on behalf of yourself or the business you represent.
3. Account Registration
You agree to provide accurate, current, and complete information when creating your account and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at hello@buuk.app.
4. Subscription Plans and Payment
Buuk is billed monthly via Stripe. Fees are non-refundable except as required by applicable law. New accounts receive a 30-day free trial with no credit card required. Taxes are excluded from stated prices and may be added where required by law.
5. Acceptable Use
You agree to use Buuk only for lawful purposes. You must not:
- Violate any applicable law or regulation;
- Upload or transmit harmful, offensive, or unlawful content;
- Attempt to gain unauthorized access to our systems or other accounts;
- Reverse engineer, decompile, or disassemble any part of the platform;
- Send unsolicited commercial communications (spam);
- Store protected health information (PHI) or other regulated health data in admin notes or any other platform field. Buuk is not designed or certified as a medical records system.
6. Subscriber Data and Privacy
As between you and [HOLDCO NAME], the Subscriber is the data controller for Customer personal data, and [HOLDCO NAME] acts as a data processor on your behalf. By using Buuk, you warrant that you have a lawful basis to collect and process Customer data and that you have obtained any required consents. Our processing of personal data is governed by our Privacy Notice.
7. Intellectual Property
[HOLDCO NAME] owns all rights in the Buuk platform, including software, trademarks, and documentation. You retain ownership of Content you submit to the platform and grant [HOLDCO NAME] a limited, non-exclusive licence to host, process, and display that Content solely to operate and improve the service.
8. Confidentiality
Each party agrees to keep the other's non-public information confidential and to use it only for the purposes of these Terms. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.
9. Third-Party Services
Buuk integrates with third-party services including Stripe (payments), Supabase (database and authentication), and PostHog (analytics). Your use of these services is subject to their respective terms. We are not responsible for the acts or omissions of third-party providers.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) CAD $100. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify, defend, and hold harmless [HOLDCO NAME] and its officers, directors, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from: your misuse of the platform; your Content; your breach of these Terms; or your violation of any law or third-party rights.
13. Suspension and Termination
You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account immediately for breach of these Terms, non-payment, or if required by law. Following termination, we will retain your data for 30 days before permanently deleting it. You may export your data during this window.
14. Modifications
We will provide at least 30 days' email notice before making material changes to these Terms. Your continued use of the service after the notice period constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia.
16. General
These Terms, together with our Privacy Notice and Service Level Agreement, constitute the entire agreement between you and [HOLDCO NAME]regarding the service. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any right does not constitute a waiver of that right.
